Texas Agreed Divorce and Modification Documents
You Have an Agreement. I Will Prepare the Paperwork.
If you and your spouse or former spouse have agreed on the terms of your Texas divorce or post-divorce modification, I can prepare and electronically submit the agreed court documents through a limited-scope legal service.

Is This Service Right for You?
This service is designed for parties who have already reached an agreement on all matters that must be addressed in their court documents.
- For a divorce, your agreement must cover the division of property and debts and any child-related terms.
- If children are involved, you must agree on parenting arrangements, possession schedules, child support, and medical and dental support.
- For a post-divorce modification, you must agree on the changes you want made to the existing order.
I review each inquiry to determine whether the matter is appropriate for this service. If you still need to resolve disagreements, document preparation can begin after those issues are resolved and the engagement is accepted.
Services and Fees
| Agreed Matter | Legal Fee | Court Costs |
|---|---|---|
| Divorce without children | $1,000 | Separate |
| Divorce with children | $1,500 | Separate |
| Post-divorce modification | $1,250 | Separate |
Court costs are additional and vary by county and required services. Filing-provider charges, service costs, and certified copies may also be additional. Your legal fee and initial court-cost deposit are due before work begins. Any unused court-cost deposit is returned.
These fees cover the services described below. Additional work or revisions may require a separately approved fee.
What Is Included and How It Works
Documents Prepared for Your Agreement
For an agreed divorce, the package includes a petition, waiver of service, affidavit supporting prove-up when appropriate, and agreed final decree of divorce. For an agreed post-divorce modification, the package includes a petition to modify and a proposed agreed modification order.
I provide the documents for review and required signatures, electronically submit the authorized documents, and monitor the status of the proposed final decree or order. When the judge signs it, I email the signed document to both parties. That completes the included services.
1. Request a Case Review
Complete the brief inquiry form below. Provide basic contact and case information so I can review whether your matter is suitable and check for conflicts. Please wait for instructions before sending detailed financial information or documents.
2. Complete the Agreements and Intake
Once the engagement is accepted, the client signs the Limited Scope Legal Services Agreement. The other party signs an Acknowledgment of Nonrepresentation. You provide the completed intake form, requested records, and applicable asset-and-debt workbook, and pay the legal fee and initial court-cost deposit.
3. Select Your Parenting Plan
If children are involved, you receive parenting-plan templates to review together. Select the plan that reflects your agreement, complete its choices, and identify every requested change. Separate child-support, medical-support, dental-support, or possession provisions may be selected when needed. Both parties must agree to the same completed selections before drafting begins.
4. Review and Sign Your Documents
I prepare the court documents from your completed intake materials. Both parties review the drafts to confirm that they accurately reflect the agreement. Required signatures, sworn statements, notarizations, and service or waiver requirements must be completed before the documents can be submitted as applicable.
5. Submit the Documents and Complete the Court Process
For a divorce, the proposed decree is submitted for approval after the generally applicable 60-day waiting period from filing the petition and after the required procedural steps are complete, unless a legal exception applies. For a modification, the petition and proposed agreed order may be submitted together when court procedures permit.
The court decides whether a hearing is required and when or whether the final order is signed. If you must appear in court, I provide instructions and a script appropriate to the proceeding. You attend the hearing without me.
Scope and Frequently Asked Questions
One Client and a Defined Scope
I represent one identified client for the limited services described in the signed agreement. I do not represent both parties, and I am not acting as a neutral mediator in this engagement. The other party may obtain independent legal advice before agreeing to or signing any document.
I prepare and submit the agreed documents without entering an appearance as attorney of record. This service does not include negotiations, mediation, court appearances, discovery, contested litigation, appeals, enforcement, or general management of the lawsuit.
Separate property-transfer documents are also excluded, including deeds, powers of attorney, qualified domestic relations orders (QDROs), and other instruments needed to implement a transfer or division of property. Those services must be arranged separately.
Must We Already Agree on Everything?
Yes. This service prepares documents reflecting an existing agreement. It does not include negotiating the terms between you. If an important issue remains unresolved, identify it before drafting begins.
Can We Choose a Different Parenting Schedule?
Yes. You may choose from the attorney-provided plans or identify another agreed schedule for review. Complete the detailed choices and list any changes you want. A selected schedule does not automatically determine child support, medical support, or dental support; those terms must also be addressed.
What if We Change Our Agreement After Reviewing the Drafts?
Changes may require an additional fee depending on their nature and extent. Minor revisions may be made without charge at my discretion. Any additional fee is disclosed and approved by the client in writing before the revisions are made. Corrections of drafting mistakes attributable to me are made without charge.
What if the Judge Requests Changes?
I explain the requested changes. If both parties agree to the necessary revisions, I may revise and resubmit the documents within the agreed scope. The revision-fee policy above applies. If the parties cannot agree, the engagement ends under the service agreement. You may seek separate mediation or retain an attorney for broader representation.
How Long Will It Take?
Timing depends on complete information, signatures, applicable waiting periods, and the court's procedures and schedule. The 60-day divorce waiting period is generally the earliest point for approval, not a promise that the divorce will be completed in 60 days. Court approval and a completion date are not guaranteed.
